The following is a basic summary of our claim policy. These are based on policies from the various mills we represent.

CLAIMS POLICY

1. CLAIMS WILL BE CONSIDERED FOR MANUFACTURING DEFECTS ONLY.
2. CLAIMS FOR LABOR IN CONNECTION WITH REPLACEMENT MAY NOT BE CONSIDERED.
3. CUSTOMERS AND INSTALLERS ARE RESPONSIBLE TO MAKE SURE THAT STYLE, SIZE, & COLOR ARE CORRECT BEFORE CUTTING AND INSTALLING.
4. CLAIMS WILL NOT BE CONSIDERED FOR VISBLE MANUFACTURING DEFECTS OR INCORRECT COLOR AFTER THE MERCHANDISE HAS BEEN CUT OR INSTALLED.
5. CLAIMS WILL NOT BE CONSIDERED FOR MERCHANDISE SOLD AS SECOND QUALITY IRREGULAR, REMANANTS, OR AT A SUBSTANTIAL DISCOUNT FROM LIST PRICE.
6. CLAIMS WILL NOT BE CONSIDERED FOR MERCHANDISE DAMAGED THROUGH IMPROPER MAINTENANCE OR IMPROPER INSTALLATION.
7. CLAIMS WILL NOT BE CONSIDERED FOR PATTERN SIDEMATCH OF PRINTED MERCHANDISE. (I.E. COMMERCIAL PRINTS)
8. CLAIMS FOR FREIGHT DAMAGE, VISIBLE OR CONCEALED, ARE TO BE FILED WTH THE CARRIER. OUR RECEIPT FROM THE  CARRIER ACKNOWLEDGES THAT THEY RECEIVED MERCHANDISE IN GOOD CONDITION.
9. IN NO CASE SHALL OUR CLAIMS LIABLITY EXCEED OUR CUSTOMERS COST OF THE MERCHANDISE.
10. COLOR MAY VARY SLIGHTLY FROM DYE LOT TO DYE LOT. CLAIMS WILL NOT BE CONSIDERED FOR COLOR VARIATIONS WITHIN ACCEPTED TOLERANCES.
11. MERCHANDISE MAY NOT BE RETURNED UNLESS AUTHORIZED BY YOUR SALESPERSON.
12. ALL RETURNS ARE SUBJECT TO A 25% RESTOCKING FEE AND MUST BE AUTHORIZED BY YOUR SALESPERSON.

Installation

THE INSTALLER USED TO INSTALL YOUR FLOORING MAY HAVE BEEN ENGAGED ON YOUR BEHALF THROUGH OVERSTOCK FLOORZ, AS A CONVIENCE TO YOU, OUR CUSTOMER. THE INSTALLER IS NOT AN EMPLOYEE, AGENT, OR REPRESENTATIVE OF OVERSTOCK FLOORZ, AND HE OR SHE IS SOLELY LIABLE FOR THE QUALITY OF HIS OR HER WORK AND ACTIONS.
